Competition Entrants

1. By entering the Competition, you hereby warrant that all information submitted by you in your entry is true, accurate and complete in every respect. Train Station Gym reserves the right to verify any information contained in your entry and/or your eligibility to enter the Competition.
2. The Competition is open to persons over the age of 13. Entrants may be required to provide proof of identity. Should the winner be unable to provide any of the required documentation upon request, they will be disqualified.
3. The Prize consists of a one year unlimited package at Train Station Gym for the entrant which includes unlimited access to the fitness centre with unlimited group class participation for 12 months from 1 January 2022 to 31 December 2022.
4. Train Station Gym reserves the right in its absolute discretion to disqualify any entrant if he/she is under the age of thirteen at the time of entry or Train Station Gym has reasonable grounds to believe that an entrant has breached any of the Rules, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with the Rules could lead to Train Station Gym disqualifying that person, without Train Station Gym giving any reason for such disqualification or granting any opportunity for challenge.
5. Train Station Gym’s decision is final, and no correspondence will be entered into.
6. Only residents of South Africa are eligible for entry into this Competition.
7. In the event that a Prize-winner is disqualified from the Competition, Train Station Gym’s authorised representative will randomly select an alternative Prize-winner from the entries received in the same manner as the original Prize-winner was selected, and such selection will be subject to these Rules.

• Competition Entries

1. The Competition is applicable to anyone who submits an original photograph on their Instagram or Facebook feed with the hashtag #TSGUnmlimited tagging the Gym’s page and/or the Gym as a location during the duration of the competition from 1 November 2021 to 30 November 2021. The photograph has to be taken inside the Train Station Gym or where Train Station Gym branding is seen on the photograph.
2. The applicant itself does not need to be on the photograph itself.
3. The applicant has to follow Train Station Gym on either Facebook or Instagram at the time of entry and at the time that the prize is awarded.
4. Winners will be selected at the end of the competition and announced on 3 December 2021.
5. If you enter multiple times across any one or on different platforms, it will be counted as one entry.
6. Employees, directors, agents, contractors and consultants of Train Station Gym and all other participating companies and their immediate families, life partners, associates, or business partners do not qualify to participate or win in the Competition.

• Prize

1. The Prize consists of a one year unlimited package at Train Station Gym for the entrant which includes unlimited access to the fitness centre with unlimited group class participation for 12 months from 1 January 2022 to 31 December 2022.

• Prize-winner

1. The prize-winner will be selected by Train Station Gym Management based on the following criteria:
   1. Creativity
   2. Originality of content
   3. Relevance to the culture of Train Station Gym
2. The Prize-winner will be notified via the social media platform that they entered from.
3. Should a Prize-winner not respond to the message within seven days of receiving notice of winning, Train Station Gym reserves the right to draw an alternative winner from the remaining pool of entries.
4. No Prize will be awarded to any entrant who has committed any form of misconduct or breached the Rules of the Competition, as determined by Train Station Gym in its sole discretion.
5. The Prize is non-transferable and there is no cash alternative. In the event of a Prize being unavailable for any reason, Train Station Gym reserves the right to substitute prizes of equal or greater value at any time.
6. The Prize-winner may be required to take part in publicity campaigns for broadcast or publishing purposes; however, the Prize-winner will not be entitled to remuneration in exchange for such publicity. Such publicity includes, but is not limited to, images, statements and information about the winners. All publicity materials remain the property of Train Station Gym and their promoters.

• Liability

1. Train Station Gym accepts no responsibility for any damage, loss, injury or disappointment of any kind suffered by any entrant in entering the Competition, including as a result of any entrant winning or not winning any prize.
2. Train Station Gym accepts no responsibility for entries entered incorrectly.
3. Train Station Gym does not make any representations or give any guarantees that:

1. Your entry or participation in the competition will necessarily result in you winning a Prize;
2. a Prize, or any aspect thereof, will meet your requirements, preferences, standards or expectations; or
3. a Prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.

• Intellectual Property Rights and Data Protection

1. Train Station Gym will use any personal information that you provide with your Entry for the purposes of the Competition and, where you have given your consent, for marketing purposes including the distribution of regular email or SMS updates or newsletters. Any personal information relating to entrants will be used solely by Train Station Gym in accordance with applicable data protection legislation.
2. The Prize-winners unconditionally agree (as a condition of accepting any prize) to:

1. the use of their name, one or more photographs of themselves and disclosure of their city of residence; and
2. co-operate with or participate in any other reasonable post-Competition publicity.

• Governing Law and Jurisdiction

1. These Rules shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
2. The Parties agree that the South African courts shall have exclusive jurisdiction with regard to any matter contemplated herein.
